Earlier this year, I posted a link to an editorial saying that fathers should have a veto over the abortion of their children. I noticed that the U.S. Supreme Court struck down a Pennsylvania law that husbands are kept informed of the intention of a woman having an abortion in Planned Parenthood v. Casey, notwithstanding such notification could be avoided by women saying abortion provider that the child was not her husband's child, or she feared violence if her husband has been notified.I expressed the view that while it is possible that the Court could reverse its opinion on the notification of husbands, but I saw very little chance of success of a consent requirement.

SSRN a new article, Fathers and abortion by Ezio Di Nucci (Universität Duisburg-Essen), in which the author deals with parental rights, but from a distinctly pro-abortion views. Dr Di Nucci argues that it is wrong for women to continue a pregnancy despite the opposition of "potential fathers," even in cases where the man will bear no financial or legal responsibility of the child.Yet he simultaneously maintains that women should keep "an absolute right to abortion." In other words, if a parent wants the unborn child aborted, views of the parent must prevail. While that it will require that deny women an abortion at the request of the father, he gives almost no explanation of why we should tolerate the "wrongful" conduct of a woman continuing with the pregnancy despite the objection of the father.

It is clear from his article that Dr. Di Nucci is committed to a philosophy, not legal argument.However, I think his article is considerably weakened by its inability to refer to real cases involving factual situations similar to those he is concerned. For example, in Evans v. United Kingdom, the European Court of Human Rights rejected the application of the biological mother to bring him forward embryonic children over the objections of his father. This case is particularly poignant because at the time of trial the woman had no other children and was unable to conceive other children because of ovarian cancer.Yet despite these facts, the court accepted the request of the man to have the embryos destroyed since the couple was not together. The result reflects that of almost all American cases on this subject. I discuss these cases in my article whose life is it anyway?
